James Franco Takes Dig at Oscar Writer on Twitter

james franco oscarsIt's no secret that James Franco's hosting job wasn't really up to par. Critics slammed his barely there attitude and general awkwardness during the telecast. But when Oscar joke writer Bruce Vilanch opened up to New York magazine's Vulture blog about Franco's flop, the actor took to Twitter to return a dig at Vilanch.

"He has so many balls in the air, he didn't get to town till Thursday before the show on Sunday," Vilanch told Vulture about Franco's busy schedule. "I don't think he realized how big a deal it is to do it until he was actually confronted with it. I think he thought he would kind of ... I don't know what he thought."

Vilanch, along with pretty much everyone else watching the show, thought it was all some kind of act.

Franco apparently didn't take Vilanch's comments too well, and he tweeted a graffiti-covered picture of himself with Vilanch backstage at the Oscars.

"James f**ked up the Oscars. Trust me, I know comedy," Franco scribbled on the photo, in dialogue bubbles coming from Vilanch's mouth. "I mean, come on, I write for Bette Midler!"

Franco has since deleted the tweet and photo, but Vulture was lucky enough to grab it before he took it down.

Charlie Sheen reaches two million Twitter followers (Reuters)

LOS ANGELES (Hollywood Reporter) – Winning, indeed.

On Monday, Charlie Sheen reached two million followers on Twitter -- less than one week after launching his account.

"Another record shattered," the actor, 45, Tweeted Monday. "We gobbled the soft target that was 2.0 mil, like a bag of a troll-house zombie chow."

Later, he added, "hey Guinness, might wanna start writing them in pencil, #checkit; you've been warned."

Last week, The Hollywood Reporter reported that Sheen will soon be Tweeting endorsements.

Lady Gaga currently has the most followers -- more than 8.6 million -- followed by Justin Bieber, Britney Spears and President Barack Obama.

Sheen is catching up, though.

Not only is he thriving on Twitter, he is heating up other parts of the web: On Saturday, he hosted a live webcast and attracted more than 100,000 viewers. He showed off a new tattoo on his left wrist that reads "winning."

$430k settlement reached in Love Twitter lawsuit (AP)

LOS ANGELES – Courtney Love's 140 character Twitter rants against a fashion designer are costing her more than $430,000, an attorney says.

The singer has settled a lawsuit filed by Dawn Simorangkir, who sued the Hole frontwoman in March 2009 accusing her of making false statements about the designer and her past in a series of postings on the microblogging site Twitter and Love's MySpace blog.

The settlement was confirmed by Simorangkir's attorney, Bryan J. Freedman. The designer's label is called Boudoir Queen, and according to her lawsuit, she first came in contact with Love in 2008 and they met in February 2009 in Los Angeles to discuss some custom clothing.

The lawsuit contained several postings written under Love's former Twitter account, courtneylover79, that accused Simorangkir of theft and of having a criminal background.

The widow of grunge rocker Kurt Cobain, Love has gained a reputation on the microblogging service Twitter, posting occasionally profane and sometimes nonsensical messages on a variety of topics. Several posts have lashed out at attorneys and other individuals who have drawn the musician's ire, with her Tweets coming in rapid succession and using every bit of the site's 140 character maximum per post.

The case had been scheduled to go to trial in February, and was expected to be the first trial in which a jury decided whether a celebrity's Twitter posts could be considered libel.

Freedman confirmed that a settlement had been reached, and said Love's attorneys had hoped to keep it confidential.

"In order to show the world the comments were derogatory and completely illegal, it was imperative to my client to have the settlement be public," Freedman said.

The attorney said a public statement will be issued next week, but the nearly $430,000, plus interest, that Love is required to pay, reflects the seriousness of the case.

"Personally I think $430,000 is an appropriate way to say she's sorry," Freedman said.

The settlement was first reported by The Hollywood Reporter.

Love's attorney, Michael Niborski, did not immediately return an after-hours phone message.

Douglas Mirell, a First Amendment attorney and partner at the firm Loeb and Loeb, said it was not surprising that the case settled before reaching trial.

Earlier rulings in the case had established that Simorangkir only had to prove that Love was negligent in her postings, not that she knowingly knew them to be false. That increased the designer's likelihood of winning at trial, Mirell said.

He said despite many of the statements in question being posted on Twitter, the case wasn't unique.

"The laws controlling what is and isn't libelous are the same regardless of the medium in which the statements appear," Mirell said.

The libel laws that would govern similar cases have been established for decades, Mirell said. Although Love lost an early motion to dismiss the case, he said there was also the possibility she could win on appeal.

Love's attorneys had denied wrongdoing, saying it couldn't be proven that some of the statements were false, and that others were protected speech.

Freedman said Love had hoped to keep the terms of the settlement private and that a public statement will be issued next week.

Simorangkir's lawsuit claimed Love became angry with her after she completed five outfits for the singer and sent her a bill.

"Love mounted a malicious campaign to not only terrorize Simorangkir, but to ruin and destroy her reputation and livelihood," Freedman wrote in a May 2009 filing.

Some of the statements directed toward Simorangkir were posted on Love's blog on MySpace and in comments on the designer's merchandise on online stores.

The designer's lawsuit does not state how much she was seeking to recoup from Love, but states her postings damaged her business relationship with several clients.

Love's attorney disagrees, stating in a filing that Simorangkir's profile actually improved as a result of Love's rants.

"She simply did not suffer any financial harm due to any alleged actions undertaken by Ms. Love — in fact, her relationship with Ms. Love greatly enhanced her business image and profits," Niborski wrote in a brief filed in December.

Mirell said that if Love lost at trial, it might cause celebrities to become more cautious about how they tweet, but probably wouldn't have much impact legally.

Freedman predicted that will happen anyway once people see the amount Love is paying.

"People are getting in trouble for Twitter postings on an almost daily basis," he said.

He said stars do need to be cautious about how and what they post online, especially when they're talking about other. "When you start talking about someone other than yourself, you are beginning to get into dangerous territory," Mirell said.

Courtney Love to pay $430,000 in Twitter case (Reuters)

LOS ANGELES (Hollywood Reporter) – Rocker Courtney Love has settled the lawsuit brought against her by a fashion designer who claims she was defamed in a series of Twitter messages.

The settlement with Dawn Simorangkir (a.k.a. the "Boudoir Queen"), which sources say was being finalized Thursday and will be announced next week, will cost Love about $430,000. The first payment of cash is due Thursday, followed by a series of payments to Simorangkir stretched out until 2014.

The settlement ends a case that was watched as closely for the unique legal issues in play as the often-erratic behavior of the defendant. Simorangkir, who became embroiled in a dispute with Love over a $4000 payment for clothing, accused the Hole frontwoman of ruining her business with a series of allegedly defamatory tweets posted during a 20 minute rant in 2009. The trial, which was originally scheduled for late January but was postponed when the parties began talking settlement, would have been the first high-profile courtroom showdown over what constitutes defamation on Twitter.

Love argued that her rantings were merely an expression of opinion and that Simorangkir could not prove how they damaged her. The fashion designer, on the other hand, pointed to Love's influence as an entertainer and the power of social media to disseminate damaging comments, including that Simorangkir was an "asswipe nasty lying hosebag thief."

"The amount of the settlement says it all," Simorangkir attorney Bryan Freedman told The Hollywood Reporter. "Her reprehensible defamatory comments were completely false and $430,000 is quite a significant way to say I am sorry. One would hope that, given this disaster, restraint of pen, tongue and tweet would guide Ms. Love's future conduct."

Love attorney James Janowitz said he was pleased with the deal. "Because of the extended payout it's a modest settlement," Janowitz added, noting that Simorangkir had asked for "vastly more" in discussions. "They got out with an amount that left them bragging rights but nothing else."

Will Love continue to express herself on Twitter? "I don't think she's using it anymore," Janowitz said. "But I could be wrong."

Sheen seduces 1.3 million Twitter fans in two days (AFP)

LOS ANGELES (AFP) – Troubled American actor Charlie Sheen was Thursday reveling in the fact that his new Twitter account had attracted some 1.3 million followers in just two days.

"In all sincerity... Thank you Twitter community for the warm reception & the followers that helped get me to 1M in 24 hours!!!" he said in a tweet posted late Wednesday.

By Thursday though the number of his followers had swelled to 1.3 million, who had to be satisfied with a mere 21 tweets, accompanied by a couple of pictures, posted by Sheen on the micro-blogging social network.

Most of his messages were not too coherent, although he did ask: "Pardon my absence.... My first concern is my kids... Back soon..!"

Sheen, 45, said on Wednesday that police had taken his twin two-year-old sons, Max and Bob, away overnight after his estranged wife expressed concern for their welfare.

But Sheen has disputed allegations that his wild lifestyle, including drug-addled binges and sharing his home with two girlfriends he called "goddesses," is anything other than a nurturing environment for his children.

Producers last week canceled the actor's hit television show, "Two and a Half Men" in mid-season, after he gave several rambling interviews, some of which included abusive statements toward his employers at CBS television.

He is also battling allegations of anti-Semitism and claims of death threats against his estranged wife, Brooke Mueller, the mother of the twins, who, like Sheen, is said to be battling drug abuse.

The @charliesheen feed was started Tuesday, and his first tweet was a cheeky photo showing Sheen with one of his new girlfriends holding a bottle of "Naked" brand juice.

"Winning...! Choose your Vice..." the tweet said, adding a link to the picture of him sporting a backwards baseball cap and holding a healthy milk drink.

But despite his new-found Twitter stardom, Sheen is still trailing far behind singer Lady Gaga who has some 8.5 million followers.

After an 11-year separation, a daughter and her homeless father were suddenly reunited Thursday.

"She just called me out of nowhere," said Daniel Morales. What set the wheels in motion was Unheard in New York gifting Morales with a prepaid cell phone and his own Twitter account. ("In a time when communication is all around us, we felt it was necessary to give a voice to the people who needed it most," reads a message on the site, which was created by the interns of the ad agency Bartle Bogle Hegarty, reports The Gothamist.) Morales quickly racked up more than 3,000 followers.

Shortly before he was to be interviewed on CNN En Espanol, Morales heard his phone ring – and it was his long, lost daughter, Sarah.

"I need to see you ... We got so much to say," said Daniel, who planned to see his daughter on Friday. As he told a bystander, "I've been looking for her for years ... She just called me out of nowhere."

James Franco, Mom and Grandma Join TwitterIt's embarassing enough for a normal person when their family members enter the social networking game and exponentially more so when that person is famous, or so one would think.

Oscar nominee James Franco has just found out how it feels, now that his mother and grandmother have joined Twitter. Luckily for the '127 Hours' star, their tweets have been pretty benign (and adorable) so far.

Franco, who joined Twitter today, is not following his family just yet, but might want to get in on the action while he's still the topic of conversation.

James' grandmother, Mitzie, who writes as @GrandmaMitz, has recently joined other "#mominees," a group of women on Twitter whose children are up for Oscars, and has, in a short time, expressed not only her pride for her grandson, but a period of time spent in Japan and her recent fashion choices.

"Just selected #Oscars gown. Designed by Madame Kiraly 35 yrs ago. Understated Japanese kimono fabric. Had to let out the seams. #mominees," she wrote.

Her account includes fan gold like, "James was very curious about everything from the time he was born--had an amazing attention span," and "No, I don't know how James does it all. Guess he thrives on creativity."

In addition to the Franco family, other Oscar nominees' moms have joined the movement, including 'The Fighter' director David O. Russell's mom, Theresa, and 'Toy Story 3' director Lee Unkrich's mom, Emilie.
