Yes, Lindsay Lohan reckons she’s famous enough to be recognised by her first name only, so she is getting rid of the “Lohan’. Lindsay’s mother Dina confirmed the news to gossip site Popeater, telling them, “Lindsay is dropping the Lohan and just going by Lindsay. Plus, me and [younger daughter] Ali will be officially changing our last names back to my maiden name, Sullivan."
A friend of the Lohan/Sullivan clan blabbed the reason for the name change, and we have to admit we can understand why the girls are changing their names, says the source “It's a way for them all to start over. No one in the family wants anything to do with Lindsay's father [Michael Lohan] anymore and that includes sharing a last name." Lindsay and her mother have had a very difficult (to put it mildly) relationship with Michael, so we’re not that surprised to hear they are rejecting his last name. We can also see why Li-Lo - oops, we mean Li - isn’t taking on Sullivan as her last name; Lindsay Sullivan really doesn’t scan as well as Lindsay Lohan. The unnamed source continues, “So many of the greatest people in showbiz are known by just their first name. Look at Oprah and Beyonce. Now you can add Lindsay to that list."

Michael Lohan Charged With Domestic Violence

MICHAEL LOHAN CHARGED WITH DOMESTIC VIOLENCE
Michael Lohan has been charged with misdemeanor domestic violence.

The showbiz patriarch must now appear in Beverly Hills court for his arraignment on May 23 in relation to an incident on Monday (March 21, 2011), when he allegedly attacked on/off girlfriend Kate Major.

Michael, 50, had originally been arrested for three domestic violence felonies - preventing the report of the victimization, false imprisonment and inflicting corporal injury on a cohabitant - but Los Angeles District Attorney's office decided not to pursue those charges.

District Attorney's spokesperson Shiara Davila-Morales said: "Evidence was found to be substantiated to one misdemeanor count."

If convicted of the offense, Michael - who is the father of troubled actress Lindsay Lohan - could face up to a year in jail.

Prosecutors are expected to recommend a $30,000 bail be imposed at arraignment.

On Tuesday (March 22, 2011) denied the accusations, accusing Kate of lying, faking her injuries and attacking him.

He said: "I didn't touch her. I didn't do a damn thing to her. When we got back to the house, she was in the bedroom and I was cooking dinner when she started screaming. She was yelling 'What the f**k is this? You're a piece of s**t. Who is Maryann Mancuso?' and that is a friend of mine."

"She was holding my phone and I grabbed it away from her. She had something sharp in her hand and she grabbed my arm and slashed my arm open. I told her to get out of here, you get your stuff and get out of here right now."

"She said I gave her a fat lip, she has Restylane in her lips. This was all a set up."

Why Charlie Sheen Keeps Winning and Lindsay Lohan Keeps Losing

At first glance the similarities between Lindsay Lohan and Charlie Sheen seem to trump their differences. Both were wildly successful in their own rights -- she in teen flicks, he in sitcoms. Both have addiction and relationship dramas, both have daddy issues and both screw up. A lot.

But while Sheen seems to be encased in kryptonic armor protecting him and his bank account from all of his misdeeds, Lohan can't even keep a movie gig, and no one wants to pay her to do much of anything, even sell tights.

What gives? Is it a male/female thing? The age difference? I don't think so. Sheen has simply made better personal branding choices. He gives America the product they want.
Bret Easton Ellis wrote in Newsweek this week that Sheen simply gets modern celebrity. A modern celebrity is one that doesn't give a crap about what the public thinks about them. They are going to do it their way, whether you like it or not. The irony is that you do like it and you will end up paying good money for more of it. Using that construction, Lohan's problem is that she cares much too much. She desperately wants everyone to like her. She proves that she becomes offended when anyone, say the cast of 'Glee,' pokes fun at her expense.

How would Sheen respond in such a situation? We imagine if New Directions started in on the actor he would be the first one to come on the show to sing his latest anthem, 'Duh, Winning, in A Minor,' and he would demand $1 million to do it. Ryan Murphy wouldn't know why he was doing it, but he'd be signing that check.

Sheen has created a brand out of screwing up. He embraces what one of my favorite business coaches, Suzanne Evans, says: "Make your mess your message," when it comes to developing your personal brand. Sheen has become the king of this idiom. In fact his messy path has become his hero's journey.

Lohan hasn't been able to commit to a message, whether messy or otherwise in the past five years. She was almost in a lesbian relationship with DJ Sam Ronson, but never fully committed to the homosexual lifestyle. She posed nude for New York magazine, but has never committed to being a sex kitten. Her multiple rehabs haven't worked, yet she has never fully embraced her bad girl persona either. She never seemed to enjoy her benders very much. Not like Sheen.

Lohan is a commodity without a brand message and that is her problem. It's also why the American public doesn't know what to make of her. We know what Charlie Sheen is. He's crazy like a fox, and he has been bringing that crazy to everything he has done in the past three weeks. Each new Sheen's Korner is crazier than the last. His live show promises to be one of the craziest nights of one-man performance since Gallagher stopped smashing watermelons.

Because Lohan hasn't embraced any single brand message, she has become unlikable. Seriously unlikeable. In 2004, Lohan had a brand awareness of only 20 percent. Her positive Q score (a score advertisers and brands use to determine how well-liked a celebrity asset is) was a 19, and her negative was a 20. By last year 84 percent of those polled were familiar with Lohan. Her positive rating reached a low of 9, and her negative rating hovered at 52. More than five times more people despised Lohan than liked her.

Meanwhile, Charlie Sheen has never been more adored. They're both messy, but Charlie's decision to embrace his mess will prove to be the best business decision he has ever made. We never thought we'd say it, but Lindsay could learn something from the warlock.Follow Jo on Twitter

Heading out for an afternoon at the local bowling alley, Lindsay Lohan and her siblings were spotted arriving at BowlMor Lanes in New York City on Friday afternoon (March 18).

The “Mean Girls” babe looked cute and casual as she and brother Michael Jr, along with sister Ali, headed inside while the paparazzi looked on.

Last night, the trio, as well as other brother, Cody, hit up a New York Knicks game and cheered the Big Apple team to victory over Memphis with the final score being 120-99.

During the game, LiLo tweeted, “With my brothers and my sister at the Knicks game!!! go knicks!! love their green uniforms for st patricks day!”

Michael and Dina Lohan The showbiz patriarch - the father of actress Lindsay Lohan - has reportedly been telling people that he wants to reunite with the mother of his children because he feels their divorce in 2007 is to blame for the "Machete" star's recent troubles.

A production source on "Dr Drew's Celebrity Rehab" - on which Michael is appearing on as he undergoes treatment for "anger issues" - says he has been open about his wish to reconcile with Dina, with whom he also has three other children, Ali, 17, Cody, 14, and 23-year-old Michael Jr.

The source said: "Michael has been revealing that he wants to get back together with Dina. It's a shocking revelation, to say the least. Michael feels that Lindsay's troubles are because of his divorce with Dina. Michael wants his family back."

"Michael is realistic that too much may have happened and that it will probably never transpire, but he says he loves Dina, even after all of the bad blood that's been split."

He even has hopes that his family will come to a "graduation day" planned this Sunday (March 27, 2011) to mark the end of his time on the VH1 show, but it is unlikely Dina and the kids will show up.

The source told RadarOnline.com: "Michael would love it if Dina, Lindsay, Michael Jr., Cody and Ali all came. He is doubtful that will happen though because they refused to participate in 'Family Day,' which was last weekend."

Michael and his ex-wife have rowed publicly in the past, with Dina often accusing him of failing to pay child support for Ali and Cody and telling the media that Lindsay refuses to talk to him.

However he has denied this, insisting that he is talking to his famous daughter every day.

Lindsay has until Friday (March 25, 2011) to decide whether to accept a plea bargain for six months jail time after she was accused of grand theft felony in relation to a $2,500 necklace.

LOS ANGELES – Lindsay Lohan is shown in surveillance video broadcast Monday texting and trying on multiple pieces of jewelry in front of a clerk in a Southern California store that has accused her of stealing a $2,500 necklace.

Snippets of the footage taken by four cameras in the Venice store of Kamofie & Co. were aired by "Entertainment Tonight" along with analysis by attorneys not handling the case.

The show obtained nearly 45 minutes of footage from the store's four security cameras, which captured the actress smiling as she entered the Venice shop on Jan. 22. "Entertainment Tonight" said it plans to air footage showing Lohan wearing the necklace involved in her criminal case during a show on Tuesday.

Lohan returns to court on Thursday, when her attorney will tell a judge whether the "Mean Girls" actress will accept a plea deal in the felony grand theft case that guarantees a jail sentence.

The video was sold by a representative of Kamofie to a commercial images unit of The Associated Press, which then licensed it exclusively to "Entertainment Tonight."

Christopher Spencer, a crisis management expert who represents the jewelry store, explained in a statement Monday the reason the footage was sold.

"Most important, we were upset with the various mischaracterizations we were seeing and hearing about the video and its contents, and we felt the video should be allowed to speak for itself," Spencer's statement read.

"There were also many media inquiries asking for release of the video, which is not any sort of secret evidence. The bottom line is we felt there was far too much speculation about the video recording, and that it was right for the public to be able to see the video itself."

A website, necklacevideo.com, has been registered and may be used to stream the video online at a later date.

The footage's release could impact Lohan's criminal case, which is the most serious charge the troubled actress has faced. Los Angeles Superior Court Judge Keith Schwartz has promised to send Lohan to jail if she accepts a plea deal to end the case early.

The surveillance video almost certainly would have been aired at a preliminary hearing if Lohan decided to fight the case.

Lohan's attorney, Shawn Holley, did not return phone messages seeking comment.

John Lynch, a district attorney's supervisor who has overseen Lohan's case, said its early release was unfortunate.

"You like to present your evidence in the courtroom," Lynch said. "That just doesn't happen as often as it used to." He noted that he would not authenticate the footage "Entertainment Tonight" aired.

"With regard to the question of Lindsay Lohan's guilt or innocence, we repeat that Kamofie and Company never gave permission to Ms. Lohan to remove the necklace from the store," Spencer said in his statement. "The rest is up to the jury."

Several defense attorneys contacted by the AP said the release probably benefits Lohan as she seeks to negotiate a better plea deal or will try to prove her innocence.

"I think it gives the defense a plea bargaining chip or a sentencing chip," said Stan Goldman, a professor at Loyola Law School in Los Angeles.

He said the release has complicated the case for prosecutors.

"They had a nice straightforward theft case," Goldman said. "Now they've got something that's really being messed up by the victims in the case trying to get something out of it. You want your victims to be sympathetic."

Criminal defense attorney Mark Geragos, who defended Winona Ryder in her shoplifting case, said, "It certainly lends credence to the defense position that the store created this 'crime' for a promotional opportunity."

Spencer said Kamofie was not seeking to profit from the tape's release. "Any suggestion that this was a publicity stunt or that there was a profit motive is a distraction from the fact that releasing the tape will allow the onslaught of calls and e-mails to receive the response as to what is on the video," he wrote.

Good News for Lindsay Lohan? Jeweler in Theft Case Sells Key Evidence

This weekend brings a major new wrinkle in the case against Lindsay Lohan, in which she's accused of felony theft by a jewelry store owner who says the actress stole a $2,500 necklace in January.

Kamofie & Co. has just sold the surveillance video allegedly showing Lindsay Lohan leaving their store with the unpaid merchandise, according to a new report from RadarOnline.com. And the sale, reportedly brokered by a media dealer who peddled the footage to both U.S. and international outlets, is estimated to be earning the Southern California jeweler more than $35,000.

"The jewelry store wanted a bidding war to maximize profits," a source tells Radar. Entertainment Tonight is reportedly one buyer; the show is expected to air the controversial footage on Monday.

On the one hand, public scrutiny of the video could further embarrass the troubled actress, who left rehab in early January, after months of trying to resolve her legal woes so she can repair her image and revive her career.

On the other hand, the prosecution's case against Lohan is in jeopardy, now that its key witness has made such a money-hungry move. In the past, Lohan's team has suggested she was set up, and as the opportunistic jeweler walks off with thousands before the case is even tried, the store's claim that they were victims of theft weakens.

"Lindsay Lohan may have just gotten the luckiest break of her life," RadarOnline.com's managing editor and executive vice president, David Perel, tells PopEater. "If the criminal case comes down to her word versus the word of the jeweler, it will be Advatage: Lindsay. The jewelry store has now used the case for profit, and Lindsay's lawyer is sure to have a very compelling argument that the cash-for-tape scandal destroys the credibility of Lindsay's accuser."

Both the prosecution and the defense are "not happy" about the sale of the footage. Lohan, meanwhile, is reportedly "terrified" of doing any jail time, but may be feeling hopeful if indeed the jeweler has sabotaged the case by selling key evidence. The 24-year-old film star's next court date is this Thurs., March 11.

Lindsay Lohan likes food!

It seems that Lindsay Lohan has expressed a new passion, a passion for food! From the looks of Lilo, it’s a new passion.

The actress has taken up cooking in her new home in Venice, California as a relaxation technique for all the stress in her life (‘totes lols’), we’re glad she’s embracing food and eating in general as a hobby (something the Heat Office also embraces with open arms).

The main reason we’re so happy for her is because Lindsay has had quite the plethora of hobbies in her past…some great, some not so great.

The not so great were actually bloody awful; Binge drinking, drugs, fights, Herbie: Fully Loaded. We can’t work out which is more offensive.

Hopefully this new found love for cooking will curb her chaotic lifestyle and we’re also hoping that the inevitable cookbook will read more ‘Beef Wellington and Chips’ than ‘Coke Frosted Shreddies with a bag of low fat Smack a Jacks’.

We wish Lilo well in her new quest. Hopefully she’s finally back to her sweet, innocent self and we can stop crying over our old copies of The Parent Trap…Come back to us Lindsay!

Hearst Heiress Lydia Hearst to Play Lindsay Lohan in New Film?

Lindsay Lohan is getting a biopic? Sort of. An upcoming Hollywood satire from grip-turned-screenwriter Charles Casillo is based on the life of Lohan, particularly the parts involving drugs and rehab. Titled 'Dogs in Pocketbooks,' the film has just cast its lead, according to the New York Post. Supermodel and publishing heiress (and, sorry ladies, girlfriend of Jeff Goldblum) Lydia Hearst will play the part of "a bratty movie goddess in and out of rehab, in trouble with the law, and hounded by greedy agents, predatory paparazzi, off-the-wall stalkers and crazed media."

This will be the first major role for the 26-year-old daughter of Patricia Hearst and Bernard Shaw (and great-granddaughter of William Randolph Hearst). She's appeared on 'Gossip Girl' and in a few movies, but nothing this significant. Casillo told the tabloid that she's "one of the few supermodels who can actually act." She reportedly beat out a lot of other names looked at for the role. Joining Hearst onscreen, Joan Collins has also been cast as a big time agent.

As for the content of 'Dogs in Pocketbooks,' it pokes a lot of fun at Lohan, but the satire is apparently directed more at the people around her, as well as the general obsession with celebrity. Anyway, as we've seen in the past, Lohan is fine lampooning her own troubles and should have no issue with a biting roman à clef. And since then she's completely thrown her career away, so she really has no grounds for protest.

This sounds likely to be aired on TV. Will you tune in to see one socialite portray another?

It’s a celeb’s worst nightmare. To turn up at the flashest bash in town, only to get turned away by a couple of beefy bouncers. It's happened to the best of them.. Alex Reid, Jack Tweed and not forgetting the time the Loose Women got turned away from Mahiki in place of Jack Tweed (LOLZ). Well now it's happened to poor old Lindsay Lohan as she attempted to get into a super posh Oscars after party.

A fellow party goer tried to help Lindsay out by asking the doormen 'Don't you know who this is?' To which they replied they knew who she was (we bet bouncers like Mean Girls and know all the words to Jingle Bell Rock) but that they weren’t letting her in (guess they didn’t like it as much as we thought…) leaving La Lohan out in the street, reportedly saying: 'This is so humiliating.' We bet it was, but probably not as bad as the Labour Pains opening night... Jus' sayin.

The party was being thrown by talent agent Gus Oseary who works for the company that represent not only Lindsay herself but also Madonna and Demi Moore.

But hang on, Lilo is best mates with Britney who defo snogged Madonna once – surely that’s a trump card to play? Alas, Linds was sent packing, showing her star in Hollywood is most definitely not as bright as it used to be.

Maybe they were frightened the sticky fingered star might nick all the canapés.

Michael Lohan has signed up for ''Celebrity Rehab'' to receive treatment for anger management issues.

The father of troubled actress Lindsay Lohan - who was ordered to spend 90 days in rehab last year after failing a court-ordered drug test - will take part in the reality TV show, which is hosted by Dr. Drew Pinsky and sees stars get help for their problems, which are usually drink or drug related.

However, sources close to Michael - who has battled addictions in the past - insist he is sober but is keen to get his temper under control.

One said: "Michael is absolutely 100 per cent sober. He hasn't been using drugs or alcohol, but he is being treated for anger management issues. Michael has tremendous admiration for Dr. Drew, and was given this opportunity to better himself, and he took it. Michael wants to deal with his anger issues in a controlled environment."

Michael also wanted to use the show to repair relations with his ex-wife Dina and become closer to Lindsay and their other three children, Ali, 17, Cody, 14, and 23-year-old Michael Jr.

The source added to RadarOnline.com: "He wants to be a positive role model for his children and he has a lot of unresolved feelings of anger towards Dina, and that needs to be dealt with."

"Producers of the show are hoping that Lindsay, Dina, and the other children would consider appearing on the show for family counseling, if they are comfortable in doing so. Dr. Drew wants to help heal this family and just get them sitting down in the same room, that would be the first step."

However, Lindsay - who could be returning to jail later this month after being accused of stealing a $2,5000 necklace - is said to be "shocked and upset" at Michael's decision to take part as she's worried he will embarrass the family.

Lindsay Lohan 'Will Be Going To Jail' If She Accepts Plea Deal

Lindsay Lohan arrived at Los Angeles Superior Court on Wednesday morning (February 23) facing the possibility of jail time, after being offered a plea deal related to her alleged theft of a $2,500 necklace on January 22. She left without accepting the deal, and with the prospect of jail still very much in the cards.

Lohan, who wore a low-cut black top to the proceedings, was told by Judge Keith Schwartz that if she does accept Los Angeles County Deputy District Attorney Danette Meyers' offer to settle the case, she "will be going to jail." According to TMZ, the deal is for six months of jail time.

Schwartz — who would handle sentencing if she accepts the plea — let it be known that he wouldn't allow her celebrity to affect his decision, telling her, bluntly, "I don't care that you're Lindsay Lohan.

"One of the things about me is that I treat everybody the same," Schwartz continued. "What I look to in sentencing is, 'What is the prior record?' In this particular case, there has been so much speculation in the press [that] I'm just going to tell you a couple of things: If you plead in front of me, you are going to jail. There might be an issue about the amount of time, but if the case settles here, you will be going to jail."

Schwartz said that if Lohan accepts the DA's deal — thereby pleading guilty to felony grand theft — she would be found in violation of her probation and would serve time. He also recommended a psychological evaluation of Lohan to help him determine an appropriate sentence.

After posting bail on the felony charge, Lohan took to Twitter to proclaim her innocence, and, with attorney Shawn Holley at her side, she maintained that tact on Wednesday. All indications are she plans to stand trial on the charge and, if found guilty, could face up to one year in state prison.

Lohan is due back in court on March 10. But before then, Schwartz instructed both attorneys to meet and discuss the possibility of accepting the plea.

Lindsay Lohan Fires Back at Rumors About Drinking, Partying

Lindsay Lohan and friends were doing damage control Friday after she was reportedly spotted at Teddy's nightclub late Thursday night. The issue? The actress is on probation and if she's caught drinking or using drugs, she'll go immediately to jail.

Reports surfaced early Friday that Lohan showed up at the Roosevelt Hotel [where Teddy's is located] around 1:45 am in her rented Porsche. She left about 45 minutes later in former girlfriend Samantha Ronson's black BMW, according to RadarOnline.com.

Eyewitnesses described Lohan as "nervous and wired" when she arrived and began looking for Ronson. And many questioned why she left her car at the hotel and drove home with Ronson instead.

"The reports i was at teddys are inaccurate...I was just at roosevelt to meet Samantha and say happy birthday to a friend," Lohan Tweeted on Friday. "i take my sobriety seriously. please dont believe this accusations. i know the rules and i wouldnt risk probation. xoxo L"

"I was with her at the Chateau Marmont last night - we had dinner and she was in great spirits and completely sober," Hervey continued. "After we left, she went to the Roosevelt Hotel to see Samantha and she left her car because she did not want any problems with the paparazzi - they are constantly following her right now."

One thing's for sure: that Lohan ended the night with Ronson. At 5am Ronson Tweeted, "Watching grey's anatomy – my fav show, @lindsaylohan sleeping next 2 me – should i wake her up to let her know her mom is going on GMA?"

In an open letter to Billy Ray posted exclusively by RadarOnline.com, Michael sympathizes with the same "scrutiny, pain and willingness to sacrifice yourself, for the sake of your family," that Billy Ray is facing. But Michael goes on to say that the pain and sacrifice are well worth it when it comes to protecting your family, even if they are initially resistant to help.

Oh My God! Am I seeing and reliving almost the same exact situations, scrutiny, pain and willingness to sacrifice yourself, for the sake of your family?

As hard and frustrating as it is, believe me when I say, it's a road worth traveled. Even if it may have its bumps and grinds along the way.

As I was raised, there is nothing like the love a man has for his family nor is there any length he will go to save or protect them.

The hardest part is, experiencing the pain that comes from the resistance of the very one(s) you are trying to save.

The one(s) you love so much, and are willing to die for, are too blinded by the "bright light" and people who use our loved one(s) while everyone thinks you are supposed to sit back and pretend it goes unseen.

As I don't see you as any one of the three monkeys with their hands over their ears, eyes and mouth. I, nor you, are the type of men who will sit back and do or say nothing at the risk of being persecuted.

When I look at what you are going through, I am forced to see myself. Two men who know what divorce and alienation, have done to our families.

Why I ask, if it so hard for our wives, children and even the public, to see that all we are trying to do, is to be there for our family and try to make things right?

Isn't it clear that the answer is so easy but the people who don't matter, make it so hard? While all we want is our family and normal lives back, others forsake that for so much more.

Why is it that people don't put themselves in or shoes? And say to themselves, "How would I feel if that was happening to me?"

The sad part is, they don't and they probably never will. But that doesn't mean that men like you and I should ever give up.

While we can't change the world, our example just might touch a few, and maybe even the one(s) we seek to save.

To that end, I want to say, that I know what you are going through, I feel your pain and frustration, and I also admire your strength, dedication and love, for your family in the name of God.

Are things getting back on track for Lindsay Lohan and Samantha Ronson?

The onetime couple were spotted leaving the Hollywood Roosevelt hotel together early Friday morning in Ronson's black Porsche, ending up at her place.

"Watching grey's anatomy – my fav show," the DJ, 33, wrote around 5 a.m. "@lindsaylohan sleeping next 2 me – should i wake her up to let her know her mom is going on GMA?"

But Lohan wants everyone to know her late night outing did not include clubbing at Teddy's, which is attached to the hotel.

"I was just at roosevelt to meet Samantha and say happy birthday to a friend," the recently rehabbed actress Tweeted Friday afternoon.

"I take my sobriety seriously," Lohan continued. "Please dont believe this (sic) accusations. i know the rules and i wouldnt risk probation. xoxo L."

Just last month, Lohan, 24, and Ronson dined at Joe's in Venice, Calif., where a source says they "shared a friendly dinner."

Lindsay Lohan to Present Top Ten List on Letterman

Lindsay Lohan is getting set to make an appearance that doesn't involve a courtroom or a Hollywood nightclub.

Instead, the troubled star is getting back into the limelight by presenting the Top Ten List on the Late Show with David Letterman Thursday, CBS announced Tuesday. Lohan will appear via satellite from L.A.

Last week, Letterman took several digs at Lohan, 24, in a Top Ten List devoted solely to her. Then on Sunday, the talk show host poked fun at Lohan again, this time while going through a Top Ten List called "Surprises at the 2011 Grammy Awards."

"Lindsay Lohan seen leaving the Staples Center with a Grammy-shaped bulge," Letterman said, referring to the felony charge Lohan is facing for allegedly stealing a $2,500 necklace.

As for the celebrity guest on Thursday's show? None other than Lohan's frenemy Paris Hilton.

Lawyer: Necklace Lindsay Lohan Accused of Stealing Not Worth $2,500

The necklace Lindsay Lohan allegedly stole is nowhere near $2,500 in value, her attorney said Sunday, and insists the actress was incorrectly charged with felony grand theft.

"We intend to challenge the prosecution's case because the truth is, Ms. Lohan didn't steal anything," her lawyer Shawn Holley tells PEOPLE. "But even if she had, it seems to me that the appropriate charge, based on the fair market value of the goods, should have been petty theft and not grand theft."

She added, "A $5 lump of coal with a $2,500 price tag is still a $5 lump of coal."

Lohan was charged with grand theft on Feb. 9, which by definition means the prosecution believes the item in question is worth over $950. Anything less would amount to petty theft, a misdemeanor that carries a maximum penalty of six months in county jail.

The actress, 24, who pleaded not guilty to the charges, faces another hearing on Feb. 23. If convicted, the maximum penalty would be three years in state prison, although legal experts doubt Lohan would receive prison time if convicted.

In a separate case, the actress remains under investigation by Riverside County, Calif., prosecutors for alleged battery of a Betty Ford Center employee.

It remains to be seen whether her new judge, Keith L. Schwartz, will eventually find Lohan in violation of her DUI probation, which could potentially send her back to jail even without a conviction in either the theft case or battery investigation.
