Pete Wentz may face a court battle against Ashlee Simpson for custody of their son.


Ashlee Simpson and Pete Wentz The rocker has filed papers asking a judge for joint physical and legal custody of two-year-old Bronx Mowgli, in contrast to his estranged wife's request for primary physical custody in her divorce papers.

Pete's legal response to Ashlee's petition - obtained by website TMZ - was filed at Los Angles County Superior Court on Monday (March 7, 2011) and also asks for each party to pay their own legal fees, which differs to Ashlee's request for Pete to pay for them both.

Ashlee, 26, filed for divorce citing "irreconcilable differences" in February, just under three years after she married the former Fall Out Boy bass player in 2008.

In a joint statement at the time they said: "After careful consideration, we have made the difficult decision to file for divorce."

"We remain friends and deeply committed and loving parents to our son Bronx, whose happiness and well-being remains our number one priority."

Despite the statement, Pete, 31, was said to be very upset after the divorce was initially filed.

A friend said: "Pete has been crying a lot to her about this. He is crushed, and does not want it to be over. Ashlee is done, she loves him, but she's ready to move on."
